In decision G1/19, the Enlarged Board dealt with the definition of โtechnicalโ and built a bridge to data, which is an essential component of computer-implemented inventions. In general, the EPC, like European national patent laws, does not define โinventionโ or โtechnicalโ unlike, for example, the Japanese Patent Act. However, it can be concluded from Article 52 EPC that only "technical" inventions are patentable (G 2/07). In G 2/07, which concerned a referral in the field of biotechnology, the Enlarged Board cited the definition of an invention given by the German Federal Court of Justice in the โRed Doveโ decision of 27 March 1969 (Case X ZB 15/67).
