Has mediation’s rise inspired a new renaissance for advocacy?   Singapore’s legal system has evolved rapidly since mediation was formally introduced into our courts in 1994. Lawyers were initially resistant. Settling seemed “soft”. It was counter-intuitive to the prevailing image of a good lawyer as the one who could use a blend of aggression and wits to outsmart and destroy the opponent.    It took nearly 30 years before we arrived at the situation today when most disputes must have first undergone mediation before it is heard in a Singapore court. Many lawyers have seen the benefits for their client and for themselves. They have broadened their skillsets and their revenue streams. They are still excellent litigators when the situation calls for it. They also know how to use mediation to obtain outcomes a judge cannot order.   Our distinguished panellists at the 'Advocacy Best Practices in Hybrid Dispute Resolution Processes' shed light on how the definition of good advocacy has shifted with the times.
